Collecting personal informations
EVINOTECA.ro has the highest standards in the client’s confidential treatment. All the data (including but not exclusive, those regarding the client’s account, transactions, correspondence) are used with maximum discretion. The only personal informations collected by EVINOTECA.ro are those given by the user, when the transactions are performed or in other operations. The simple navigation of the site doesn’t require collecting personal data. Some functionalities or servicies from the site require providing some personal data; these will be used only in the purpose for which they were given and/or for the communications between the site and its clients, when these are necessary (for example: confirming an order, announcing the holiday’s program, discounts, promotions).

The prices are posted on the site in lei: LEI (RON) with TVA. Products payment The ordered products stay in VINEXPERT property until the whole payment is made.
The payment of the ordered products can be made:
1. repayment/cash at delivery (clients non-legal entity)
2. bank transfer into our account (legal entity or non legal entity clients)
3. on-line using the banking card (credit/debit card, including Romanian cards
4. payment at delivery (cash or credit/debit card) at the merchandise pick-up from our stores. Cash payment The cash payment is made in lei to the agent that makes the delivery, at the moment of receiving the products. Payment through bank transfer. CUI: R11763890 Payment with on-line card. You can pay on-line using your personal card or the firm’s card, in complete safety conditions. The accepted cards are the ones that have VISA and MASTERCARD sign. No additional
commission is perceived for the transaction. For correctly finalizing the transaction, you have to introduce the card code (all the 4 groups of numbers from the face of the card, without spaces), expiration date and the last 3 numbers engraved on the back of the card (this feature may be
absent). No matter the currency, the transactions are made in lei, at your bank exchanging course. Products delivery The ordered products are delivered in the country, after choosing the way and delivery term at the order is carried out. The products are in the package you have choosen and are secured on the way until delivery. ORDERS DELIVERY IN BUCHAREST is made: • FREE at your headquarters – if the value (with TVA) is over 83 EUR
• The cost of the delivery (for orders under 300 RON) is calculated like this: 2,75 EUR for packages up to 10 kg, after which is added 0,20 EUR for every extra kilogram.
ORDERS DELIVERY IN THE COUNTRY is made:
•The cost of the delivery is calculated like this: 2,75 EUR for packages up to 1 kg, after which is added 0,20 EUR for every extra kilogram.
• For the localities that aren’t in the distribution network (please see the list of cities from the signing in / order form) is calculated an extra cost of 0,20 EUR/km for the distance between the destination
locality and the nearest city from the distribution network.
All the costs will appear in the pre-invoice, separately from the cost of the purchased products.
In case of an advance payment through bank transfer, the delivery term is calculated from the moment the whole sum is in Evinoteca.ro account.
In case you can’t be found at the assigned data and hour, you will be reached at the phone number you stated, otherwise Evinoteca.ro will keep the goods for 3 working days, in this period we will try to contact
you to finalise the delivery. If you can’t be contacted, the order will be canceled.
In special cases (the ordered products aren’t on our stock or the suppliers too, transport difficulties ) we have the right to increase the delivery period.
VINEXPERT has the right to deny orders/deliveries from certain clients or to certain addresses.
Validity term, Guarantee and/or Products Service
The products that are marketed through this site have, the validity term, guarantee and/or service offered by the producer. The guarantee can’t be invoked in case of improper or incorrect use of the product. In maximum 48 hours from the products delivery, in case of finding some problems, the client can solicit our company to return the product/products, only in the original package and along with the original papers that prove the transaction. In this case, we can replace the object with an identical one or – if that isn’t possible – he can receive his money back. Personal Data
On the site http://www.evinoteca.ro, the user is responsible for all the activities that occur by accessing the account and personal password. VINEXPERT can’t be made responsible for the errors occurred due to the users negligence regarding he’s account and password confidentiality. The user’s personal data will be used by http://www.evinoteca.ro and its suppliers only in the site’s declared purpose. The data from the signing in account, as well as the data from the order form will be used to the user order confirmation, reports about promotions, etc.
Personal data can be sent to the authorities to check commercial transactions or other authorities to make any justified verification according with the law, if this thing will be solicited according to the
current law.
Informations security
VINEXPERT guarantees the security and confidentiality of the informations hosted and transmited through its system. VINEXPERT doesn’t take responsibility for the loss of informations caused by any soft damage or error that the site uses and also doesn’t guarantee the fact that the site’s, server/servers or sent mail by http://www.evinoteca.ro don’t contain viruses or other harmful components. Also, VINEXPERT doesn’t
answer for the damages that endargers the server’s security that hosts the site. We guarantee confidentiality and security but we don’t guarantee the software’s security or stability.
Products and servicies responsabilities
The products (when it is the case) have the producer’s guarantee certificate. VINEXPERT won’t be held responsible for any lack or misagreements or any other aspect that regards them. Any complaints should be done to VINEXPERT in maximum 48 hours from the products reception, so that it can be sent to its suppliers, for solving.
In case the products can’t be delivered or suffer damage during delivery, the client can ask for full refund, but not other damages. VINEXPERT doesn’t guarantee the availability in stocks of all shown
products. For this reason, VINEXPERT has the right not to respect the order if the product is not currently purchased. The client will receive his money back from VINEXPERT for his order.
Declining guarantees and responsibility limitations
VINEXPERT doesn’t offer any guarantee to the users regarding the availability of its services, the correctness of the informations published or the security of the services.
The content of the site (texts, products descriptions, tehnical characteristics, images, symbols) is property of VINEXPERT and its partners and was made in collaboration with the suppliers of the shown products.
The images are presented on the site as reference, but the delivered products can be different from the pictures in any way (color, accessories, aspect etc. )

VINEXPERT doesn’t take responsability and can’t be made responsible if the purchased products don’t correspond to the purpose for which they were acquired.
Also, VINEXPERT doesn’t offer any guarantee no matter what the consequence may occur, caused by non-functionality of the service, informations delay or the security of its applications.
VINEXPERT won’t be held responsible for any damage, no matter the sort, both direct, indirect or accidental damages. We are not responsible for any damage, no matter what kind.
Price policy. Products transport.
The prices of the products are shown for every single one of them. VINEXPERT can make any promotional campaign for the products shown on the site, promotions of which conditions will be set entirely by VINEXPERT.
Litigations
Any attempt of unauthorized access at the site www.evinoteca.ro and any fraud attempt will be reported without delay to the specialized authorities. All the litigations will be resolved in a friendly manner. If the litigation can’t be resolved in a friendly manner, or one of the parties doesn’t want to resolve in a friendly manner, the litigation will be solved by the arbitration of the International Commercial Arbitration Court near the Room of Industry and Commerce of Romania and Bucharest. The decision is final and obligatory. The invocked major force and proved by one of the parties according to the law, exonerates the parties from obligations – except the duty to pay for the servicies performed until its appearance – on the whole period of the major force.
Transport damages
The received products will be checked in the presence of the agent, and if unfortunately the products prove to have problems because of the transport, the client has the right to turn down the order and please inform about the damages at sales@evinoteca.ro. VINEXPERT will refund the value (if the payment was made in advance) or resend the package at the client’s request.
Author rights (COPYRIGHT)
The whole content of the site www.evinoteca.ro – images, texts, graphics, symbols, WEB graphic elements, scripture, programs and other data – is the property of VINEXPERT and its suppliers and protected by the author’s rights Law and by the laws regarding intellectual and industrial property. The use of the elements enumerated above without VINEXPERT’S permission is punished according with the laws in vigour. Comments, Communications and Other Dates/Informations
The persons that access/visit the site can make comments and other kind of communications; can send e-mail, transmit suggestions, ideas, questions or other informations, as long as their content is not illegal, obscene, threatning, slanderer, don’t harm in any way the private life of other persons, don’t violate the rights of intellectual property, don’t contain viruses, texts that target different promoting campains, chain letters, or any other spam. Extra Taxes
The final price, paid by the client is formed from the product’s price and the expedition expences. VINEXPERT doesn’t perceive an extra tax from the client at the purchaise of the product. For any extra perceived tax, please address sales@evinoteca.ro
Final provisions
If any of the clauses above turn up to be null or invalid, no matter the reason, it won’t affect the validity of the other clauses. Once the client launches the order, he accepts without opposition the terms and conditions of use, the value of them is the same as an closed valid contract. |
